BILLS ON COMMERCIAL AND ADMIRALTY COURTS AND JUVENILE DELINQUENCY
The Council of Ministers, on the 6th of May 2019 passed the Bill approving the establishment of the Commercial and Admiralty Courts as well as the Bill on juvenile delinquency.
A. Commercial and Admiralty Courts
The Minister of Justice and Public Order Mr. Ionas Nicolaou, said that the introduction of the Commercial and Admiralty Courts is an important measure that is part of the reorganization and modernization of Cyprus’ judicial system and will be an essential foundation for change.
The Courts will set up fast-track procedures for specific commercial cases, (those whose claim value exceeds two (2) million) as well as admiralty trials without the current claim value limitation of two (2) million. This reorganisation aims on one hand to establish Cyprus as a centre of commercial services, as well as to strengthen the efforts of the Deputy Ministry of Shipping, to further promote Cyprus as a well-recognised shipping services centre.
The Minister of Justice and Public Order added that the Courts shall have the ability to trial cases in a short period of time (nine (9) months to one (1) year) which will attract not only investors but will also make Cyprus’ judicial system comparable with other countries' systems.
In order to achieve that, the judicial systems of other countries have been studied, both in the commercial and admiralty sector, especially that of Ireland which is similar to Cyprus’.
B. Juvenile Delinquency
The Bill on juvenile delinquency is a child-centred legislative framework for handling cases in the child's best interest and the implementation of procedures that are appropriate, modern and based primarily on the best interests of the child, being minors up to seventeen (17) years old.
These procedures are mostly out-of-court and their aim is to address juvenile delinquency and achieve the juvenile’s delinquent behaviour rehabilitation through out-of-court programs. In this respect, the juvenile will only be brought before court in exceptional cases and in cases where the out-of-court procedures fail.
The Bill was drafted, having primary and outmost focus the child’s best interest, in cooperation with the Commissioner for the Rights of the Child, a consultation with the wider public sector, all the co-competent services, and even a public consultation lasting about one and a half (1.5) years.
The Minister also added that these out-of-court procedures and the juvenile delinquency framework will ultimately, amongst others, contribute in tackling issues related to school bullying as well as any other issues related to schools that are part of the juvenile delinquency frame.
The Bills are currently under consideration by the House of Representatives for their approval.
